Az alábbi közérdekű adatigénylésére válaszolva tájékoztatom, hogy a Magyar
Államkincstár a közérdekű adatigénylésében szereplő adatokat nem kezeli.

 

Indokolás:

Az Infotv. 26. § (1) bekezdése rögzíti, hogy a közfeladatot ellátó
szervnek a kezelésében lévő közérdekű adat megismerését kell lehetővé
tennie, amelyet a közérdekű adat törvényi definíciója is alátámaszt, mivel
az Infotv. 3. § 5. pontja értelmében közérdekű adatnak a közfeladatot
ellátó szerv kezelésében lévő és tevékenységére vonatkozó, vagy
közfeladatának ellátásával összefüggésben keletkezett információ minősül.

 

Jogorvoslati tájékoztató

 

Felhívjuk szíves figyelmét, hogy az adatigény elutasítása vagy a határidő
eredménytelen letelte esetén, továbbá ha költségtérítés került
megállapításra, és annak összegét vitatja, az Infotv. 31. § (1) bekezdése
értelmében bírósághoz fordulhat. A pert jelen elektronikus levelünk
kézbesítésétől számított 30 napon belül a Magyar Államkincstár ellen lehet
megindítani a Fővárosi Törvényszéken. Amennyiben álláspontja szerint Önt
az adatigénylése kapcsán jogsérelem érte, vagy annak közvetlen veszélye
áll fenn, az Infotv. 52. § (1) bekezdése alapján a Nemzeti Adatvédelmi és
Információszabadság Hatóságnál (a továbbiakban: NAIH) vizsgálatot
kezdeményezhet. Megjegyzendő, hogy ha az igény elutasítása, nem
teljesítése vagy az adatigénylés teljesítéséért megállapított
költségtérítés összege miatt a NAIH vizsgálatának kezdeményezése érdekében
a NAIH-nál bejelentést tesz, a fent hivatkozott pert a NAIH-nál tett
bejelentés érdemi vizsgálatának elutasításáról, a vizsgálat
megszüntetéséről, az eljárás jogsérelem megállapítása nélküli lezárásáról
szóló, vagy a NAIH által megtett - és esetleges további - intézkedésekről
szóló értesítés kézhezvételét követő 30 napon belül lehet megindítani.

Dear sir or madam,

 

I submit the following data request pursuant to Section 28 (1) of Act CXII
of 2011 on the Right to Informational Self-Determination and Freedom of
Information (hereinafter referred to as the Information Act).

 

I am contacting you on behalf of Citizens for Responsibility and Ethics in
Washington (CREW), a United States based civil society organization
committed to building an ethical, transparent, and accountable government.
CREW uses cutting-edge research, groundbreaking litigation, and innovative
policy proposals to advance our mission. As part of this effort, CREW
frequently files freedom of information act requests in the United States
and uses that information to inform our litigation and produce in-depth
research analyses, all of which can be found on our website

Specifically, CREW requests:

 

1. Any and all documents related to payments, considered or realized, made
from the government of Hungary, or Hungarian government officials, to
properties owned by US President Donald Trump, The Trump Organization, or
his family members during the time period of October 1, 2016 to present.
These family members including but are not limited to; a. Donald J. Trump,
b. Donald Trump Jr., c. Eric Trump, d. Ivanka Trump, e. Jared Kushner, f.
Tiffany Trump,

 

2. Any and all documents related to payments made from the government of
Hungary to crypto currency products owned and/or operated in whole or in
part by President Trump including but not limited to; a. World Liberty
Financial, b. DT Marks DEFI LLC c. CIC Digital LLC, d. Fight Fight Fight
LLC, e. Celebration Cards LLC, f. The “$TRUMP” coin, g. USD1 stablecoin,
h. Trump Digital Trading Cards (NFTs), i. NFT INT LLC, j. NFT
International LLC.

 

2. Any and all documents, payments, planning materials, communications or
other materials related to the development of a Trump property in Budapest
or any reference including but not limited to the following companies; a.
The Trump Organization, b. DT Marks Budapest LLC, c. DT Marks Budapest
Member Corp.

 

According to Section 30 (2) of the Information Act, I request that you
send me the copies and other requested data electronically to the sender's
e-mail address. If the requested data cannot be sent by e-mail for any
reason, I request that you upload them to the website
kimittud.atlatszo.hu. Please search for responsive records regardless of
format, medium, or physical characteristics. We seek records of any kind,
including paper records, electronic records, audiotapes, videotapes,
photographs, data, and graphical material.

 

If the data controller for the contents of this request is not the
Treasury, I request the appropriate data controller to be identified. Our
request includes without limitation all correspondence, letters, emails,
text messages, facsimiles, telephone messages, voice mail messages, and
transcripts, notes, or minutes of any meetings, telephone conversations,
or discussions. Our request also includes any attachments to emails and
other records, and anyone who was cc’ed or bcc’ed on any emails.

 

Pursuant to Section 29 (3) and (5) of the Information Act, compensation
for the fulfillment of my data request may only be determined if the
fulfillment of the data request involves a disproportionate use of the
workforce resources necessary for the performance of the basic activities
of the body performing public tasks. In such a case, the data controller
is entitled to determine the cost of the workforce expenditure related to
the fulfillment of the data request as compensation. Please inform me in
advance electronically if you would determine compensation for the
requested copies of documents. In this case, I ask that you attach a list
of documents to the information, indicating the page number for each
document, the amount of the workforce expenditure related to the
fulfillment of the data request and its hourly rate.

 

Please, if you consider only part of the requested data to be accessible,
send it to me together with the partial refusal of the data request,
pursuant to Section 30 (1) of the Privacy Act. Please note that, according
to the position of the National Authority for Data Protection and Freedom
of Information NAIH/2015/4710/2/V., this data request cannot be refused
under Section 29 (1b) of the Privacy Act, as it contains the name and
contact details of the data requester. According to the NAIH position, the
data controller cannot request the provision of any further data, nor is
it entitled to verify the identity.

 

CREW intends to analyze the information responsive to this request and to
share its analysis with the public through reports, press releases, or
other means. In addition, CREW will disseminate any documents it acquires
from this request to the public through its website,
